I tend to agree. This reminds me of the suit involving Star Wars and Battlestar Galactica.

George Lucas and Twentieth Century Fox sued Universal over the similarities between SW and BSG (Twentieth Century Fox Film Corp. v. MCA Inc.) and while the case was granted a summary judgment to dismiss by the district court, the Ninth Circuit Court of Appeals didn't agree and said there were enough similarities to go forward with the case.

(In the end, the two parties settled out of court.)

The similarities between Star Trek and The Orville are more blatant than were those between Star Wars and Battlestar Galactica. Not saying they would win, but if Paramount/CBS decided to file, they could probably drag out the case for years, encouraging Fox to drop their show.
